3 month delay in issue of PCN!!

Hi

Last week I received a PCN from a private company Civil Enforcement Ltd (based in Liverpool) with a PCN issue date of 22nd February, for an incident which took place on 8th December 2015. Is there a set period, like with the Councils, that they are able to issue a PCN because 3 months seem excessive even if DVLA were snowed under and couldn't get my details to them that sharpish?

Any help would be greatly appreciated

    Please read the Sticky thread for NEWBIES where the timescales, and therefore winning appeal points can be found.
    For a windscreen ticket the PCN must arrive between days 28 and 56 from the day after the alleged event.
    For ANPR the PCN must arrive within 14 days starting the day after the event.


    Once you have read the NEWBIES thread you should appeal using the relevant template you will find therein. (BPA template in blue text.)

    in simple terms, its 6 years to invoice a driver, if they know who that is (they dont normally know but will assume the keeper is the driver anyway)

    but to comply with POFA2012 against the keeper , its 56 days , which they failed

    but in any case you need to appeal is so read that NEWBIES sticky thread near the top of this forum, learn the topic, appeal using the blue text template, dont risk a possible court case

    Do understand that your appeal must be in the 3rd person. No "I parked...." it is "the driver parked..."

    But your first point of appeal - you actually only need 1 - is that you received a Notice to Keeper or PCN outside the timescales laid down by POFA 2012. As keeper, you are, therefore, not liable. Only the driver is liable and you decline to supply their name. It was so long after the event took place that you can not be sure who it was.

    You suggest that they cancel the charge as in any appeal or court scenario, you will rely on POFA as your defence.

    And you do realise not to send it by letter?

    THE KEEPER emails CEL but with the postal address and name of the keeper, and PCN and VRN on the email of course. Like the thread says.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
