Default On credit file

Hi i recently found out that 02 had placed a default for the amount of £9.50 on my credit file . After further investigations into this i found out it was a phone that my son had being useing and due to his age at bthe time i was made the account holder.
At the end of the contract they (O2) issued a termination bill for the amount of £9.50 and sent notifcation to an online account which we did not know existed so never knew anything of this bill. Since then 02 have placed a default onto my credit file and it is causing me alot of problems as iam trying to obtain a buy to let mortgage even thowe it has now been settled and showing as settled.
My question is should 02 legally have informed me of there intensions by way of sending me some info on this bill by way of letter through the post before they are legal entitled to place a default on my credit file.
And any advice on getting the default notice removed would be a great help
Thanks Chris

Many companies use e-billing now. I dont think I receive a single bill through the post anymore.
However your post isnt clear. You said they sent a termination bill and also an online notification - So did you receive the bill in the post?
As it stands, you owed o2 £9.50 and you didnt pay. As such this is correctly recorded on your credit file. You would have agreed to them relaying information in regards to the state of your account when you signed the contract.
Defaults stay on file for 6 years after settlement.0 -

As it stands, the account is still open as there are funds outstanding. After this has been cleared and the account closed, the default will remain for 6 years.0 -

That's not correct.
The default remains on your credit record for 6 years from date of judgement irrespective of whether or not it has been paid off. (unless it's paid off in full within the first month following judgement, in which case it will be removed from the records).0 -
Hi Thanks for the replys but my main question is can O2 proceed to make a default on your credit file without sending you some sort of notification that they intend to do so ie send you a (hard copy) letter to your home address informing you of there intensions.
Thanks0 -
Did they directly place a default, or is this a county court judgment that hasn't been paid? (It's not clear from what's written in this thread).0
