Car Finance PPI over 10 years old burden of proof iquestion

Hi, I had car finance with Renault Hire Purchase from march 2004 to jan 2006. I'm pretty sure that the policy included PPI. When I called the lender to check they said they only keep records for 6 years so I would have to provide a copy of the agreement and bank statements as proof.

Of course I dont have the agreement, but I do have bank statements showing I made payments to them (these don't seperate out PPI from the main loan payments, they just show one payment per month) and I have my equifax credit report which also includes a record of this 'loan'.

Is this enough? I dont actually have proof of the PPI but I think this should be enough to prove I had an account. Also when I called to enquire the agent said 'yes you probably did have PPI as we sold it at that time'.

Should I just take a punt and send a letter with the bank statements and credit report, or is there anything else I can do? Or do I not stand a chance without proof of the PPI?

Thanks, Jenni

You need to complain to the car dealer who sold you the PPI (if you did have it) along with the finance as you would be complaining about the sale of the PPI. Unfortunately car dealers were not regulated in 2004 so would probably just dismiss your complaint without even looking at it. The only circumstance where you could complain to the finance company and hold them responsible is either if they actually sold you the PPI (perhaps a phone sale after the finance had commenced) or if the dealer was actually an agent of the finance company (which is not usually the case).
