Inheriting property that was inherited

My grandmother died in 2000 leaving a partial share of the home she co-owned to my mother.

My mother died intestate in 2008.

As it stands the Land Registry title bears the names of the other owners only and as far as I can tell my family's interest in the property has not been registered/lodged.

Letters of administration were sought for my mother after she died but this property was not known about then. Anybody care to tell me what my first step should be?

    Was grandma named on the property Title? Was it a registered Title? Who is currently named? Is it now a registered title?

    Did grandma leave a will? Who was the Executer? Was Probate granted?

    Who owns the rest of the property? Do they acknowledge or dispute ownership of grandma's / mum's share?

    Who was granted Letters of administration for mum? Was Probate Granted?

    Are there Inheritance Tax implications to either grandma or mum's estates?

    Depending on the answers, either

    * get together with the other relevant parties and correct the Land registry Title, relying on the various Grants of Probate

    * pay any IT due (or at least contact HMRC to declare missing asset)

    * consult a solicitor specialising in wills & probate.

    As googler has said, you need to take legal advice on whether the beneficiaries of your mother's estate now have an interest in the property and, if they do, if/how that should be reflected on the register. There are a number of quite complex and involved scenarios that may apply here, which would be difficult to cover in the necessary detail in this public forum.


    For example, on the question of who is currently shown as the register as the owners the fact that your mother's name doesn't appear doesn't necessarily mean that her interest is not protected because the registered owners may be holding the land in part as trustees for her.
