Best way to get ridiculous(?) defects removed??

I say ridiculous defect as they seem ridiculous to me but I may be mistaken.
I have 2 defects sitting on my on a TRS account from last year both for "cancelled for being out of stock".
In both instances items were shipped via myhermes and tracking was uploaded to ebay.
Both parcels initially got lost by myhermes I was in constant contact with my buyers with regards my efforts to get myhermes to locate them.
Eventually after 10 days I refunded both buyers (who were very understanding throughout).
(On the 11th day both parcels were actually delivered by myhermes and both buyers got their items for free. And I lost £160 as myhermes state that theirs is not a guaranteed service and they can take as long as they like to deliver a parcel)
My mistake seemingly was that I cancelled the order rather than
getting my buyers to open Item Not Received cases against me and then refunded them that way??
I think I was under the impression that an INR case would result in a defect. Which I now believe it doesn't??
Anyway I emailed ebay customer services via their dispute a defect section and have received back a cut paste email that basically says my dispute doesn't satisfy any of their criteria for defect removal.
Despite explaining all of the above and providing tracking that proved both buyers received their items (for free) after I refunded them.
So what's my next step surely I have a case if anyone will actually listen? Because I don't believe "Max" at ebay customer services even bothered reading my email.
Is there a phone number and a good time of day to ring it when I'm likely to get someone with some authority and some basic common sense?

There used to be something called the "powersellers forum" does that still exist?

You won't get anyone with authority and common sense.
Defect removal policy is in use for certain defects which are 90 days or less old.
It sounds like it's of your own making unfortunately. An out of stock defect occurs when you either cancel for that reason (out of stock) or if you refund without a cancellation.
You may find a rep who will help but I would doubt it. One of the oldest tricks in the ebay book is to say you've sent something and then refund - I hasten to add, I appreciate that's not what you've done, but that is why that defect was brought in.0 -

Sometimes you don't, sometimes the actual signing into Ebay will do it, but more often than not you will have to sign into the boards again. It started being like this when Lithium took over the moderation and pinks turned into blues.
As for today, it's just been a nightmare signing in anyhow.0
