  • Wouldn't it be interesting, with the photo showing the ticket, for them to try court. Which they won't of course.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

And the reason they couldn't see our ticket is because the parking attendant stuck the PCN over it.

Complain to the DVLA, local press, your MP, and social media about the parking scumpany and the company that employed them, explaining their underhand tactics of covering up the valid parking ticket.

Please also read this and get everyone you know to sigh the petition.

Have you complained to the Mayor of St Ives?

AFAICS, the chances of this reaching court are zero. Judges are not fools, they can recognise a scam when they see one. Have you considered reporting them for tax evasion? Read this.

This company appears to have a problem with v.a.t. If, as they claim, this is contractual charge, it is a fee for parking, and thus vatable. Have they accounted for vat on their paper work?

Ask them for a vat invoice, (in order that you can consider payment). If they ignore your request, (which they probably will), it is a useful stick with which to beat them if it ever gets to court.

Wow...the scum put the fake PCN on the SIDE window to cover the P&D ticket!

This is the payback for the Government taking clamps away from such knuckle-draggers, they try other tactics and use & abuse law (POFA) and case law (Beavis) to rip off consumers even though neither POFA nor Beavis applies.

How the heck did the bunch of beggars at TNC get your phone number? If you put it in the so-called appeal (which was doomed, should not have bothered) that was a mistake you will regret unless you TELL them to 'cease and desist with all contact because this is harassment and the alleged debt is denied' Phone down.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

TNC are part of the CSA, so you can formally write to them and state no more phone contact, all contact by post. if the ignore this, you can then complain and escalate.

You can also write to them stating the debt is denied and give a copy of the ticket. The case should therefore be referred back to the principal. Again, if they ignore this, the case can be escalated to the CSA

  • My thoughts exactly! Why would they have put the PCN on the drivers door rather than the windscreen? I've never seen this before... Unless, they're covering something up!! Which of course they were.

Please bear in mind that as far as debt collectors are concerned the CSA is no different than the BPA. An old-style trade protection association aka old boys club.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
