Direct debit hasnt been collected for six months

I opened a phone contract with Caprhone Warehouse when they dealt with Talk Talk. Alas they no longer deal with them and all custom was diverted back to talk talk.

Upon transfer I was told it would no issue to the customer.

I have no found out that Talk Talk hasnt collected a direct debit (eight pounds a month) for over six months. Though no letter or anything like that was given. This is through no fault of me

What are my rights. They have cancelled the contract, I understand why.

They have notified equifax as a default

    If you believe that the information reported to the credit reference agencies is incorrect, then you should contact them in order to a note to the offending item and hopefully get it corrected. Talktalk normally bill you online, do they not? And also provide details of payment mandates etc? So have you received any bills at all in the last 6 months?

    It does seem rather odd that nobody has attempted to contact you in 6 months.

    Who is the beneficiary of the direct debit? Was a different direct debit set up when you transferred?

    Edit: It looks like if you log in to your account, under 'Bills & payment' you can make a one off card payment, so you shouldn't have any trouble paying what is owed.

    You do need to pay it in full. And you should if you want to get your credit report(s) corrected.

    If I were you I'd log in to online banking and print a copy of the screen showing the Direct Debit is set up.

    I would then send that with a letter to TalkTalk and ask them to remove the negative information from my credit files(s).

    No online account, nothing what so ever.

    At the start of the contract Carphone warehouse was the beneficiary. I guess it should have moved to TT however it did not. Carphone warehouse informed me that me details were sent from Carphone to themselves.

    They are insiting I pay in full, which I cant as it is well over three hundred pounds including fees. Ideally I would like to withdraw from an obligations, I accept this may not be possible.

    If the Direct Debit is all set up and waiting to go, but TalkTalk has simply decided not to take they money, you shouldn't have to pay the full £300.

    I would pay the £48, or so, that's really owed; then write to them with evidence the Direct Debit is set up.

    My issue is that it is Carphone warehouse at fault as during the move back to talk talk my details were not processed correctly allowing TT to take my money when I was assured all would be smooth.

    I will of course pay what I think is owed, IF that is what is needed.

  • You have to accept YOU have a responsibility to monitor your direct debits.

    Being able to escape your obligations is unrealistic.

    Your best outcome here is to negotiate a timescale to pay what you owe and get them to remove the record from your credit file.
  • I have taken advice that says, I cannot dispute the entry and pay off the debt with the expectation that my credit will not be affected.

    I will not pay for Carphone warehouse mistake. Not today or anyday

    That to me is unfair. If Talktalk had notified me by text or letter I would accept it is all my issue alas they did not

    Also TT are insisting a full payment. I have spoken with them many times. They have ended the contract thus needing me to settle the account
