Need advice on faulty caravan

Hi
I just wanted some advice or opinions.
Brought a nearly new caravan 9 months ago and we've been having some problems with the toilet leaking. We have since taken it back to the dealer who have told us they can repair it but they will have to cut the floor Lino across the bathroom doorway to get access.
I'm not keen on this as I feel that the caravan will be altered in a way which may cause us problems in the future. I feel that the caravan will be butchered to fix a fault that is not our fault. The work is to be carried out unde warranty.
What shall I do??

  • They said the only way they could fix it without cutting the floor was to take the whole back end of the caravan off but I don't know if it's a feesable thing for them to do. I just don't want to be left with a butchered caravan and feel I would rather have my money back if I was within my right to do so

    You are unlikely to get your money back.
    After nine months use - including a good chunk of last summer - even if you were able to force some sort of refund, I would expect a significantly reduced refund.

    In my opinion, you need to make it quite clear to the repairer/seller that any subsequent problems with the 'butchered' floor would be unacceptable.

    Even if they did have to give you a refund, they could reduce that refund to take account of the use you have had.

    If you've had it 9 months then the sale of goods act would apply. After 6 months, the supplier can ask you to prove that the fault is inherent before they offer a remedy - so the supplier seem to be doing good so far by not asking for this.

    If the fault is inherent, then you're entitled to a repair, replacement or refund. You can request a preference but the retailer can refuse if your chosen remedy is disproportionately costly in comparison to another. You cannot force a remedy that is impossible or disproportionately costly. But any repair should be carried out within a reasonable time and without causing significant inconvenience.

    If their modification isn't affecting the value/benefit of the contract for you, then I don't really think you can reasonably object to it. So, does it affect the value or the benefit you derive from the contract? Is new lino perhaps not another alternative?

    Cutting the lino at the door way is not 'butchering the caravan' just make sure they join it with a floor bar(can't remember what it's called)after the fix. Or maybe try and push your luck by asking them to replace the entire piece of lino.
