Hi wonder if someone can help
On 12th January
Purchased 2 new sofas at a cost of approx £1700 this includes a protective coat to protect them
Sat on 3 seater.Cushion totally different to other settee it sinks.Also loud squeaking.Informed shop within one hour
Been inspected twice both agreed there was something wrong with it
Now they want to take it away to the manufacturer and have it repaired. We have told them we want it replaced
If not we will have our money back
They are passing the buck to the manufacturer saying they will see what they say.Told them I dealt with shop
Would like to know where we stand
Was paid on credit card

If it was within 30 days you could have rejected the goods for a full refund.
You've posted this after 30 days but haven't mentioned what's happened between then and now so it may well be too late - in which case you have no right to be demanding any replacements or refund as they're well within their rights to attempt a repair first.0 -
From purchase been inspected twice.Once by an independent sent by shop.Once by their own staff
First checked after one week then on 27th day
Then asked to wait till they sorted it
But did notify shop on the day it was delivered that there was a problem. They couldn't send anyone till the following weekRemember only people who say money doesn't matter have already got enough :think:0 -
you advised shop within one hour of delivery so this was within 30 days of new consumer rights
you rejected the article but had to wait for shop to inspect thus time waited for their response
so long as this time waiting does not go over the 30 days ie they have only just advised that it will go back then you can still reject
you really need to get onto citizens advice now to log this in case you have to fight for a refund in court0 -

Ring them back and point out that you'd like to invoke your "30-day right to reject" under the Consumer Rights Act 2015.30-day right to reject
Under the Consumer Rights Act you have a legal to reject goods that are unsatisfactory quality, unfit for purpose or not as described and get a full refund - as long as you do this quickly.
This right is limited to 30 days from the date you buy your product. After 30 days you will not be legally entitled to a full refund if your item develops a fault.0 -
Post# 8 sums it up nicely and all I would add that after you ring them, write to them confirming your request stating the timeline and the 30 day rule.
If they do not agree to replacement/refund you are then in a much stronger position than having to rely on telephone calls.0 -
And if the shop don't refund promptly then you have the additional advantage of S75 cover making your credit card issuer jointly liable, so you're in a very good position to get your money back from one or the other.0

And make it absolutely clear (per post #8) that you are exercising this right as the goods do not conform to contract ... this is NOT a change of mind cancellation.0
