ESA stops in few months

I have just been transferred to ESA from SDA and put in the work related group until October and then my money stops .
I appealed against the decision but it didn't get changed .
I have grand mal seizures every week and petite mal ( Blank spells ) several a day causing confusion afterwards.
I currently get DLA would there be anything else I could claim when ESA stops my husband works full time earning over £16,000.
I wish I could work and would love to but who would set me on having seizures every day .

    f your condition has worsened, you could asl to be reassessed for ESA. have you looked at the support group descriptors to see if any apply? for ESA.
    on an income of 16k, your husband could apply for working tax credit
    did you ask for a reconsideration or take an appeal to tribunal?

    Can't understand why it would stop as you would have another review before they decide to take you off ESA .People have a date when this will happen on their award letter, son placed in wrag after been transferred from IS and SDA olso petite mal sufferer and will be looked at again in 2yrs. Although they could at any time if they want. Did you appeal the wrag decision to get into support group as you can't appeal time before they assess you again.

    Oh right I don't think it could get any worse really , yes I appealed against two of the support group descriptors but they say I didn't come into them .
    I'm not sure about tax credits as we don't have any young children .
    It was a reconsideration I asked for and after reading the letter makes me not want to take to tribunal . Thankyou for your reply .

    Yes the letter says I can only receive it for at the most 365 days so it's taking it back to when I originally sent the form back last year even though didn't get transferred over to ESA until this math.
    Yes I appealed to get in support group which would then continue .

    ESA claim would continue, but payments would stop as WRAG is limited to 365 days for contributions based ESA.

    did you have supporting evidence?

    its your choice to go for appeal or not, but there is a ,ich better chance of winning at tribunal than at reconsideration.

    as for working tax credits, the cut off for a couple is around 18k, so you should get something if your partner earns 16k.

    apart from housing benefit/council tax support there is nothing else i can think of

    a mandatory reconsideration is not an appeal

    Hi yes it states that but because my husband earns over £16,000 I won't be able to receive it ! It's all wrong isn't it way they do things

    thats right.
    you will still be eligible to claim ESA ( and your NI credit will continue to be paid)
    you would need to swap to income related ESA after 365 days and your partner earns too much for you to receive a cash benefit

    it may seem wrong to you, but between the state supporting you and your partner supporting you ...

    the state can't keep on paying indefinitely for people that have another source of income. that is why it switches after 365 days to income related for those in the WRAG
