POPLA Code issued then received letter re: Byelaw 14

Hi all,

Having more ongoing problems with Indigo. I have previously appealed 2 PCN's received on a railway station carpark, the appeals were rejected and POPLA codes issued.

I have since appealed to POPLA and am awaiting an outcome, in the meantime I have received a separate letter relating to each ticket, one from 'PCN Debt Recovery and Prosecution Service' and one from 'PCN Admin Centre' (a trading name of ZZPS limited). Both are demanding payment of an increased charge and threatening prosecution under Byelaw 14.

This is concerning, especially given I have been issued a POPLA code for each, accompanied by a response clearly stating the appeals route is via POPLA.

I would welcome advice on how to approach this? I am in the process of drafting a complaint to the BPA due to the previous problems I have had with this company.

    I would ignore any debt collector letters but as they are under appeal, then I agree you need to draft that BPA complaint letter

    its either a bylaws issue and magistrates court, or its a private parking issue where popla applies (for Indigo), it cannot be both
  • The only PPC to try a section 14 bylaw prosecution to my knowledge were slung out of Doncaster Magistrates in 30 seconds flat and told never to return without a toothbrush and pyjamas.
    I do Contracts, all day every day.
  • Can these letters have any impact on credit rating etc. or wold it need to go before the court and a CCJ be issued?

    your best option would be to go down the POPLA route, without mentioning by laws or anything else.
    If the PPC starts playing up then you should eb able to easily string this out for 6 months

    Email aos@britishparking.co.uk and complain about this intimidation by debt collectors with the word 'prosecution' when this is in fact being dealt with by way of civil charges, not a penalty and both are at POPLA. To continue to chase with debt collection whilst cases are at POPLA is a clear breach of the BPA Code of Practice - say so.

    Have you had the evidence for each POPLA appeal? I'd never sit back and just wait for an outcome, not saying you are but just to point out, that's dodgy unless you can see their POPLA evidence is full of holes. If you have not had the PPC's evidence pack, also complain about that to the BPA (and POPLA) if the Portal shows POPLA have had the evidence at their end.

    YOU MUST BE GIVEN A CHANCE TO READ AND REBUT THE EVIDENCE. Are you at that stage? Keep the ball in your court.

    Thank you for your help.

    I am chasing the evidence pack for one, POPLA say it was sent to them 6 weeks ago and i have emailed the operator 5 times now with no response. I have asked POPLA for an extension and this was one of points i was going to complain to the BPA about. I am waiting for the evidence pack for the second too.

    I suspect the OP has previous threads that explain the scenario up to now which is why we ask people not to start new threads but to tag onto the existing threads, for continuity
