Sorry to resurrect this thread...
Solicitor is now seeking sight of the purchase property's rights to use the tank as it's on the neighbours property.
Has anyone else with a shared tank had any issues at this stage with a purchase ?
I refer you to my Post 19.
It says about all I can say on the subject. I don't mind sharing the facility with the neighbour, now there is the ability to go down a different route if the current harmonious situation should change.0 -

A septic tank requires All users to abide by certain agreed shared rules.
We had one, it was a blighted temperamental beast & I'd hate to think of anyone else being allowed access to it.
However, if you're more determined than I think, see if you could get your own personal tank sorted & leave this other beast to the other householder. (It is possible they are watching the sale with the same anxious "Oh Gods?!" I feel, but possession of the tank is 10/10ths!)
(In years to come, when you are faced with nappies & small portable items than do not decompose willingly (playmobil figures, if I recall correctly) you may look back on this "Tank? Yes, research, whyever not" conversation & yearn to beat your younger self around the head.)
That said, the google map looks green & friendly & a great place to rest the eyes upon.

Thanks guys. I need to re-read the post now the conveyancing has got to this point.
If no right exists then I'll ask for that to be created before I exchange.
The vendor has stated that it's been emptied and an inspection report generated but I've not seen that yet.
Another issue is my solicitor wants to see that the tank has been registered with the EA.
Add to that, the drainage search came back incorrectly stating the property was connected to mains sewerage. That's being re-checked with the water authority.0 -
It's a sensible question. You'll recall I raised this for you back in post 28.....
In my own case, there was no legal right to use the tank. After living there around 8 years I decided to remedy this (to avoid future problems) and agreed a Deed with my neighbour which is now lodged with both properties' Titles at the Land Registry.

Update:
Solicitor hasn't been provided with sight of the necessary rights to use / access the tank so at this point it looks likely they don't exist.
It's not a point my Solicitor requires a resolution to in terms of my mortgage lender but I'm loathed to accept all the risk that this won't be an issue that raises it's ugly head when I try to sell.
How much did it cost you in the end G_M to get the deed setup with your neighbour ?
If it's approching the £1K mark I may ask if the seller is willing to split the cost.0 -

The reply from the Seller's solicitor is that as the tank was installed long before 2015, it doesn't need to be registered with the Local Authority. I'd read the same with the only caviat being that the soakaway is more than a prescribed distance away from any watercourse, which in this instance it is.0 -
