Problem completing Housing benefit application

The question asks me if I am a student.

I tick NO.

Another question asks if I pay council tax,

I don't pay council tax as I am still enrolled on my Uni course and will return to it in September.

BUT I will be moving in to my accommodation in 2 weeks...

So I don't know if I should tick yes to am I student question even though I won't receive my student loan until September???

Can you see my problem?

I am a student taking a gap year and have not received my student loan yet???

So I don't pay council tax as I have not withdrawn from my course, and I am afraid to tick YES to being a student as I have not received my student loan yet.

Fed up and confused :(

    In some circumstances they can, for instance single parents and disabled students.
    Unless I say otherwise 'you' means the general you not you specifically.

    Do you actually read the responses you get on this forum?

    You keep making threads which contradict what you say,

    What do you think a person at university is, They are a student, They are studying. So you would tick YES.

    I thought you had to have some sort of intelligence to get into university... Maybe?

    It's actually possible to fall into a grey area about being a student, if you've temporarily left a course but are going back to it. You're not studying or enrolled on modules, but you are on the uni system somewhere.

    I've no idea where this half status would leave someone for benefit purposes though.
    Unless I say otherwise 'you' means the general you not you specifically.

    in this case , the claimant receives ESA and PIP which would still be paid.
    and because they are disabled, housing benefit is also still payable even if they are still classed as a student

    Housing benefit would be reduced due to his pension and student loan income though.

  • During your gap year you are not a student. When you return in September you are a student. So you tick no to being a student and yes to being liable for Council Tax.

    With your claim form provide a letter explaining your circumstances will change in September. When you re start your course provide details of your loan etc.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
  • Before renting a property have you:-

    1) Spoken to the DWP to see if you ESA will cease due to Student Loan and Private Pension.

    2) If ESA ceases how much Housing Benefit you are likely to get.
