Not to mention OP that you have to mitigate your losses.Your rights are to be compensated for the damage caused.
Ultimately, if you took them to court, the court would need documented proof of your losses.
My suggestion is that you start collecting your evidence and converting it to monetary values.0 -
If you had wiped up the tea straight away you wouldn't of had stains....Baffled though how one cup of tea could cause so much damage, carpet, walls,mattress and damage to the drawers?
I personally would take the discount offered, buy a mattress cover and get rid of the stains, the mattress is not a second or not fit for purpose it arrived in perfect condition and you made the brew and either placed in the way or let them take it into the bedroom...Time to take some responsibility yourself!0 -

Thankfully Bensons seem to be more reasonable than you and have offered to pay for the damage caused by their delivery men.
But isn't that the point everyone is making - if you want them to pay for the damage, you need to provide the evidence, hence quotes for carpet cleaning and decorating. I fail to see how one cup of tea has caused so much damage and I imagine that they are thinking the same. Of course they want evidence before paying up, any company would. Provide the evidence and they'll then pay up, if its too much 'hassle' to do that then just accept you're not going to get anything further. You shouldn't need to take time off work to arrange quotes, from my experience tradesmen are very accomodating in coming during early evenings/weekends to price up. Just get it done or move on. Sorry if that sounds harsh/blunt.0 -
I agree with a few of the other posters who feel that you are trying to milk the situation. I have spilt tea on my carpet (several times - I can be clumsy) but I cleaned it up immediately and there is no stain. I've never heard of walls needing painting after tea was spilt on them or damage to drawers that needed rectifying at expense.
It is possible that the fitters didn't notify you until they'd finished, by which time the stain had become permanent. If this is the case then you would have a point. My instinct, though, is that you're trying to earn out of the situation.0 -
I've also got to get a carpet cleaned, wall painted and a new top to a chest of drawers plus I've had to use two days holiday to take delivery.
I've had faulty goods delivered and am expected to pay full price for it.

They are probably asking you for quotes as that is a lot of 'damage' from a cup of tea...
They will no doubt want to check it is genuine rather than someone trying it on and just wanting a pile of money.
If the damage is genuine, you will need to get quotes surely to get the work done that has ruined your bedroom????
I would suggest:
£2.99 for some carpet stain remover
£0.99 for some cloths
£1.99 for a bottle of wall cleaning product
£20 for your own labour.Should've = Should HAVE (not 'of')

Some people seriously exaggerate their perceived 'loss'. Just how much 'damage' can a spilt cup of tea really do?
The op wants over £800 for a drop of tea being spilt. Ridiculous!
As the post above mine lists a fairly simple solution, I would go for that if I were the OP.

But that is not the same as what Poppie68 said. She said that the op should take responsibility for the damage because either they left the tea in the way or they let the delivery men take the tea into the bedroom. Blaming the op for allowing delivery men to take tea into a bedroom seems unreasonable to me. Poppie68 also said the op should just take the £130 offered.
That is not what Bensons have said. They have said they will pay for the damage if they are given quotes. (So they are not blaming the op.) This seems reasonable to me.0 -
Do you have photos of all the damage? They might be handy if it does go as far as court. I've had quotes done before for painting and new carpet etc and they have been quite happy to come after 6 or at weekends or later.
