I think i am very much out of time for being able to successfully dispute or appeal anything given that I have seen that appeals/ disputes should be done within 30 days and no longer than 3 months. Looks like there is a lot of burden on me to prove that it is their mistake and I believed that the payments they made were right. I can prove the mistake part very easily. However I think they will come back with what has already been said on this thread, which is I should have checked even though I believed my claim to be correct.
I am going to follow all the guidance I have received on here and I am very grateful for the replies. Can anyone give me an idea as to the success of this though so I can set my own expectations.
Thanks again
The appeal is 30 days from the decision letter. You haven't asked them yet to change the 2014/15 income so they haven't yet made the decision.
As I said in my previous post, you'll get a letter from their decision and you'll have 30 days from there to request a mandatory reconsideration.
Even if you missed this for some reason, appeals can be accepted late up to 13 months.0 -
Ah Darksparkle you are a beauty!
Everything can seem so damn technical and confusing. Right thanks again. Fingers crossed!0 -
Rang them. It's getting "referred" as they can't alter a figure by the amount i want.
They expect it not to get changed due to it being a "real time figure" from the p60. Even told me my employer should have deducted it off the p60. SMP is on the p60 separately. But I don't think it is my employers job to deduct is it?
However she did confirm your approach which is to appeal when they say they won't update it.
Thanks again very appreciated and sorry I haven't grasped everything straight away. I will keep you posted on how it goes.0 -

It's a tax credit rule to deduct to £100 per week SMP. Your employer isn't expected to do it or even know about it.0 -
Hi there again
I am after some clarification as to what to do next after following the previous advice.
I updated my income to reflect the lower amount due to SMP.
This is the response :
"thank you for telling us about your income for 2014 - 2015.
We have received your annual declaration for the tax year 2014 - 2015. You told us your actual income was xxxx.
On 13 may 2015 you told us that your change of circumstances within your annual declaration were correct.
To make sure that you receive your correct entitlement to tax credits please tell us straight away if your circumstances change. If you don't, you may not be getting all the money you are entitled to, or you could be building up an overpayment that you may have to pay back.
Yours sincerely
Tax credit officer"
And that's it. What does that actually mean? They are or are not going to reassess? No word on here about how I appeal this but it doesn't sound like a decision.
Can anyone tell me what needs to be done next?
Thank you0 -
Doesn't answer either way.0

Yes I know.
What should be my next steps?
They sent me a dispute letter but I left that because that was a result of phone call number 2. And advice on here was to update my income.
They still haven't contacted me to advise whether they will claim this overpayment at a lower rate, which was phone call number 1.
Anyone on here with any advice I would very much appreciate it. I'm at the end of my tether. I would rather not ring them again (will if I have to) because out of 3 phone calls none of them gave me the correct advice.0 -
I finally have a letter from this dispute to say that they can't treat my dispute as a mandatory reconsideration but they have rectified the income mistake on my award notice and will reissue advising my entitlement to tax credits. If something doesn't add up I can ask for mandatory reconsideration.
Now with this being for 14-15 income and we are now in 16-17 are they revising the 16-17 notice or 14-15? And once they update will (or should) this recalculate what I should have been entitled to throughout 15-16?
Any light on this would be appreciated. I know it may be best to wait for the award notice but that will be another two weeks. I want to be on top of this situation. This whole thing has taught me to be much more prudent.
TIA again0 -
If they correct 2014/15 then an award will be sent for 2014/15.
It could the potentially have a knock on effect on 2015/16.0
