error of contents in purchased flat

    You thought you were getting a flat without an alarm, briefly you mistakenly thought there was one, then you did indeed get a flat without an alarm as you initially expected and were happy with.

    Even if you were sure you could win and it would be smooth and easy, do you really want to put somebody through all that because they ticked the wrong box on a long form? Would you be ok with somebody doing that to you or a friend of yours?

    Seriously why would I increase my offer just because there was a burglar alarm fitted?

    If it doesn't make any difference to the value of the flat or your decision to buy it, you haven't suffered a loss, have you?

    Bear in mind that this hypothetical alarm could be of a completely useless specification, or not in working order.

    You have suffered no loss because of this simple mistake, so you won't gain much traction in court.
    Only if you can show you paid more because of the alarm, or only bought because of the alarm, or suffered losses because of what you believed, could you then convince a court.

    Because if you had done so, it would have established the quantum of your loss. That's why the question was asked.

    If I was asked to maybe I might have but I was not.

    In my opinion it is no different to ticking boxes saying there is a washing machine,dryer and fridge included but are not there.

    If I was to go to court it's a no brainer as it was stated an alarm was fitted and it is not.

    They will pay my solicitors fees and an alarm should be fitted.

    Not necessarily. You'd have to demonstrate that you genuinely believed that there was an alarm, and that you had been misled by the error made in the fixtures and contents form.

    But ooops, you've already indicated that you were aware that it was an error.:)
    I think they ticked the wrong box as there is no sign of one.

    And even if you did win, you wouldn't the cost of fitting an alarm, you'd win the value of a second hand alarm. And you wouldn't necessarily get awarded costs, not once the court worked out that you were a chancer. :)

    If you have concerns about security, concentrate on the important stuff; door locks, window locks, unsecured ladders, lighting....

    I thought I was hyper-secure til, 3 weeks after we bought our current gaff, an enterprising burglar used a neighbour's scaffolder's unlocked ladder and a crowbar to jimmy open an upstairs timber window...

    .. which WAS locked but whose robust-looking catches were only secured with half-inch screws!

    They are now triple safe with extra catches and two-inch screws!

    Took me about thirty quid and four-five hours DIY to upgrade the fixings... or about as much time as you could waste fruitlessly pursuing your vendor for the phantom buzz-box!

    I rest my case
