Facing eviction and homelessness

Doesn't sound like you're doing the greatest job at the moment! You'd rather see them homeless than follow the advice given by everybody to stay where you are.
I find this message highly insulting, both me and my partner would do anything for our children and for you to say I'm not doing a great job, who do you think you are?
In addition to some other questions, I'm on a debt management plan with step change and we have to receive some housing benefit which makes it difficult when looking for other properties, being self employed I find the winter months quite a struggle which is when we need HB and then in the summer months can get by without it when it obviously gets stopped when income goes up
Some people have also said I'm being dramatic, I suffer from depression, anxiety and ADHD (since young) so obviously I'm just finding this whole matter a little stressful!0 -

Anyway, don't worry about the details and concentrate on the house search0 -
Compare local letting agents and see if the one with the cheapest credit check/application fee has a suitable property. That way if you do fail the check you won't have lost too much money. Are you currently receiving housing benefit? If you're in a period of time where you aren't then don't mention that you claim it in winter as there's no need for anyone to know that.Don't listen to me, I'm no expert!0

Yes, I can see they are responsible adults, he is running his own business for goodness sake, besides all his health issues..... private landlords do not like benefit tenants and the council don't want to know... I suppose you want him to buy his own place and get a mortgage do you?0 -

In that case please, I beg you, for your children's sake re "do anything for our children " do not leave on the date the landlord is asking you to, do not make yourself "intentionally homeless" and simply calmly & politely wait (don't prompt landlord what to do..) for landlord to serve a valid s21 or s8 then follow the process: If nothing else it buys you significant extra time - and (I am not being sensational..) park benches are cold & wet this time of year...

I've rung around a few today, the problem will be getting the deposit and rent upfront
One issue that has frustrated me is that I've found a private landlord and he is desperate for tenants to move in for about 1 weeks time, 2 maximum, I said that won't be a problem as our landlady wants us out
I gave her a call and explained and she said you legally have to give me a months notice and won't accept any less, I'm starting to think she isn't doing us any favours, one minute she wants us out, the next I have to give her a months notice, this could be our real chance of getting somewhere with the private landlord but she's not having it, I'm starting to think the many comments above are correct, maybe she's not looking out for us in the way I thought she had been0 -

So reply and say that if you are not able to leave early you will have to wait for her to evict you0 -

Her reply is not that of someone wanting to sell with vacant possession. I think you are dealing with a liar & a crook (who quite possibly doesn;t declare her rental income).
Was deposit protected & "prescribed information" served on you within 30 days of you paying it? (if not any s21 will be invalid).
Do you have an address for her for you to "serve notices" in England or Wales? (Could be c/o agent: If no address in EorW then rent is not due).0 -
Stop and think because once you give notice to leave there are major repercussions if you do not!
Have a word with the proposed new landlord and explain your predicament. He should be aware of the laws relating to all of this anyway.
If you can get the deposit and the new place is suitable go for it. Ideally you want to move out of the old place (with most of your deposit back) and into the one as easily as possible.
What you must avoid is giving notice to leave and not having anywhere else to go to.
Plus everyone on here has been giving you the legal position not the moral one. You might find it distasteful but I promise they are all telling the truth!0
