Shared access road & land - how to find out details of ownership

Hello, me and my partner are currently looking at a victorian house, we absolutely love the house, however it has no driveway to the front, or anywhere to put one and no on street parking (double yellows). There is however rear access.

The house we are looking at is semi detached and on the left, to the right of the house we're attached to is an access road which then leads to the side of their garden and gives rear access to their house, our house and houses to the left of us, and also to the house on the right of them. Behind the house to the right of the one attached to us is a row or garages which lead into the gardens of the houses behind us. There is a small area in front of the garages with cars parked but it looks like a free for all.

Although not ideal, because we love the house so much we feel we can deal with having parking in our garden only, the thing that worries me is finding out who owns or who has responsibility for maintaining this road. The beginning of the road is tarmacked but full of pot holes, then when it turns behind the gardens it turns into a dirt track.

What I want to know is, is there a way for me to find out who has a right to use this area and who should be maintaining it, we don't mind contributing towards upkeep but obviously we would rather know before we put in an offer.

    1) ask the seller/owner

    2) ask the neighbour

    3) Look for a Land Registry Title (map enquiry)

    4) beware assuming you can park in your garden - check planning laws or speak to local planner

    5) look at Title for the property to see if there's a ROW

    6) look at Title for the neighburing property to see if there's a ROW

    We asked the seller and they park opposite the house in front of someone else's house as they are friendly and the owner doesn't drive but obviously I don't want to count on this.

    The 2 neighbours 2 the right of us have cars parked in their back garden and both have garages in their back garden so I'm assuming this won't be a problem.

    I've just searched the map enquiry and it doesn't shop up on the map at all, so not sure what this means?

    Probobly unregistered land.

    What did the seller and neighbours say when you asked them?

    When i spoke to the owners they stated that it is shared access and that you can park on your back garden or the area of land by the garages.

    The title is available for the house we're interested in and for the neighbour, would you recommend purchasing both and taking a look? Are they relatively easy to figure out, we're first time buyers so trying to make sure everything is correct and we don't get ourselves into a situation we're not expecting. Also is it the title deed or the title plan I should be looking at?

    We haven't spoken to the neighbours yet but we have a 2nd viewing tomorrow so could try and speak to them then.
  • Get both and get the other bit as well as the Title Plan (think its called "Register entry"). Its only a few £s after all...

    What the owners and the neighbours say will have no standing in law. You need to be sure of what rights you are buying with the property.

    The plan for the house we are looking at has the house and the gardens outlined in red. The neighbour has their house and garden outline in red and then a part behind their garden outlined in red and green? Although nothing in regards to the actual access road?
