Re claiming PPI charges

Hi, I recently asked Capital One to look at my claim again regarding a PPI claim that I made in 2011 of which they rejected me at the time. I paid PPI for a period of over 7 years and felt that I had been mis sold the insurance. When they rejected me in 2011 I was about to take it to the FOS when my dear Father passed away and I was in a bit of a turmoil. Now getting back to some sort of normality,I requested Capital One re-open my claim and sent in another claim form. I have today received a letter saying that they will not look into the case again as it is more than 6 months since their original decision and the FOS will not help because of the time factor. Is it worth me making a complaint to the FOS?

The FOS do have the ability to overrule the timebar. However, they are quite strict on it. Death is one of the examples they give as a reason they may overrule it. However, you have to justify the whole period from when the complaint was rejected until now.
That is going to be a problem for you as you complained in 2011 and its now 5 years later. The death of your father would affect you at the time but it wouldnt affect you for 5 years. More like an extra 3-12 months. So, I suspect it would be highly unlikely the FOS would overrule in this case.
