    or a child could have had an eye out, or an old lady could have injured herself, or a person doing charitable work could have been injured

    Realistically though is there not the need for some proof that said fence caused the damage?

    Post right above yours.
    Generally any claim has to satisfy the following elements:
    1. That a duty of care was owed
    2. That they were in breach of that duty
    3. That the breach caused the loss/damage
    4. The damage was not too remote.

  • I haven't been on here for ages and forgot about this, so thought I might update with something positive for a change. I'd written to them anyway just to make sure they were aware and they send back a letter of apology, said the fencing had been moved to let machinery through and not put back so accepted there wasn't enough room to walk past easily and they'd replaced the broken bits, and enclosed a £20 H&M gift card which I was mega chuffed with (I love H&M), got a new rain jacket off a sale rack and had enough balance left for socks as well! Wasn't even expecting a reply so it's nice that they did that.
