Hiya,
I Recently got a new phone from perfect homes and had to sell it due to financial issues and have fallen behind on payment and perfect homes are now asking for the goods back and are refusing to take payment. What action will they take?
Thank you x

They will pass your account to a debt collector, who will attempt to get you to pay up. if you've sold the phone, they can't have it back can they !!I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Might not have been yours to sell as they use HP agreements.A hire purchase agreement is a form of credit agreement. Hire purchase means that the goods remain the property of PerfectHome until the last payment has been made. You cannot sell the goods for the duration of the agreement. It also means that we can ask you to return the goods if you don't make regular payments.
Hire purchase agreements are regulated by the Consumer Credit Act 1974.
For more information on your rights and obligations please have a look at the guidance provided on the DirectGov website. While you are still making payments, you aren’t allowed to sell or dispose of the goods without the lender’s permission. If you do, you’ll be committing a criminal offence.

Ha ha no, debt is not a crime, it's a civil matter, neither is defaulting on a credit agreement, this is not the 1800's !!!

The information superhighway is at your fingertips, I suggest you educate yourself a bit !!

Selling goods you don't own is probably not a civil matter. While you are still making payments, you aren’t allowed to sell or dispose of the goods without the lender’s permission. If you do, you’ll be committing a criminal offence.0 -
I have offered to pay their money and they have refused to accept it they just want their goods.0

Apologies OP, it's been a long and tireing day, kids on half term and all that, slightly frazzled nerves already !!!
They are wanting there goods back, you can't comply as you have sold them.
You can either write and tell them this, in which case they will probebley want the value in money, or, you can ignore them, and eventually they will come to the same conclusion, and pass the account to a debt collector.
I very much doubt the police will want, or need to become involved, don't worry, don't panic, although yes it is technically a criminal offence, the police have enough to do and won't be interested in why you sold your phone, the worst that can happen is you will be chased for the value of the goods by a debt collector, it will be then up to you how you choose to deal with it .I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. I would tell them you no longer have the item, put the offer to pay in writing and send it registered so you have proof they receive the letter.
Then wait and see what the response
If they accept your offer then send them a cheque so you have proof of payment. If they don't then when they take further action you have proof that you offered to pay.
