As others have said, the employers have a duty to ensure that all employees have tghe right to work. Your family member will need to to take steps to get some valid form of ID - if they don't have a change of name deed than re-doing this may be the quickest way forward, to then provide long-form birth certificate + wage slip or p60 from previous employer showing NI number + Statutory Declaration showing change of nameAll posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0

If this is a youngster (and it may well be if this is the first time they've been asked to prove Right to Work!) then they may be using a passport which their parents applied for, or renewed a passport which their parents applied for.They must have provided their birth certificate to get the out-of-date passport so why didn't they know the surname was different?
Actually that may be one reason why the employer wants a current passport: the passport DS3 used when we went to America would never do for ID purposes now, he was still a child in that photo! And at 16 he looked very different!!!Signature removed for peace of mind0 -
I've passed on what info I can to them they have been working for the firm for 20 plus years.
It has been aledged that an employee at the head office had sold personal data of the staff in the company I think this has been propted by some staff taking legal action.
As for the passport I believe a written letter was supplied with the reason the name was different at the time and it was accepted. I think as for the surname it may have been an issue with the father from the last marrage stopping the surname change at the time their was no google to consult or moneysavingexpert.
I guess the issue with the surname was forgotten about after the passport was obtained.Kind Regards

I would take agrinnall's advice and sort out a passport, it's worth the £72.50.
I ended up getting one just for identification purposes and not for what it is intended.0 -
How do they have passport on a different surname to their birth certificate. They would need that to apply for passport.

The op's relative could take the easier and cheaper route of changing their name by deedpoll to the old original surname. This would enable them to be able to provide a proof of ID.Never Knowingly Understood.

the fact of the matter is that this IS a legal requirement and it WILL keep cropping up - my disabled brother renews his passport every 10 years ONLY for the purposes of having valid ID - he is epileptic so doesn't drive- in fact he hasn't been out of the country since 1987 - but still renews his passport because it is less hassle than any other options0 -
The company has probably woken up to the requirement to see proof of Right to Work in the UK, or is now auditing their records. For some purposes it is an acceptable form of ID, ie establishing that the person named and photographed on this bit of plastic is the person standing before you.do they have a valid UK FULL driving licence ?

They will probably need to show a paper trail - parents' marriage certificate, their own birth certificate, divorce papers and/or second marriage cert (depending on whether the surname was changed to a step-father's name or the mother's maiden name).
They used their mothers divorce papers and marriage certs the company accepted this.
Going to look at helping them sort it out maybe through deed poll so all docs match up.Kind Regards
