Family member Possible dismissal from work Need Help!!

Hi all I am after help on behalf of someone in my family.

They have been told they have to prove who they in work. They have given their gas, electric and passport but this had ran out and the employer would not accept it as a valid form of identification.


When they found their birth certificate it had a different surname on it to the one they have used since age of 4. I don't know the ins and out's to why their surname was never changed.

The employer has said they will be thrown off site if they don't have any other way to prove who they are this week and claims it's because of the welsh government that they are having to do this.


Is this legal or is their something that can be done to stop them being dismissed

tbh a bill is not good ID, anybody can present or forge a bill quite easily, usually passport, photo driving license or birth certificate is required.

as for taking them off site, depends on their policy i guess, your family will have to prove they are who they are. The surname thing will not help, my surname was also changed before i was old enough to know what a surname is but I have the paperwork to go with it.

Where does your family come from?

The employer needs to verify two things:

1. Family member is who they say they are (fraud perhaps?)

2. Family member has the legal right to work in the UK.

Showing up with an expired passport and a birth certificate without their surname on it isn't going to help their cause in accomplishing the above two goals

I may be wrong but I thought that employers now have to ascertain the eligibility of their employees to stay in the country. Presumably the first step in this process is for the employee to produce evidence of their indentity.

Surname on the birth certificat was from their mothers first marrage.

2. Family member has the legal right to work in the UK.

All family members are born and raised in the UK

Yes, but EVERYBODY has to provide valid documents which prove that fact. The employer is complying with British law - this is the same elsewhere and not just Wales.

The employer is correct and the only thing that can be done to stop a dismissal is that the person provides the required documents. There is a heavy fine for any employer found not to have made these checks on all employees, regardless of where they may have been born or raised.

Renewing a passport costs £72.50, if it's that or losing the job the choice seems pretty obvious.

born and rais ed in the uk with no valid ID!! yikes.

nowadays you to provide id before you work, so i advise they get a passport so they have some real ID.

They must have provided their birth certificate to get the out-of-date passport so why didn't they know the surname was different?

They will probably need to show a paper trail - parents' marriage certificate, their own birth certificate, divorce papers and/or second marriage cert (depending on whether the surname was changed to a step-father's name or the mother's maiden name).

This is a list of acceptable documents.

Personally, I think that an out of date British passport is OK - if you scroll down to page 24, then there seems to me to be a clear distinction indicating that some documents which have to be valid - but a UK passport just has to show right of abode.

From page 13 we get this bit about using your birth certificate to establish right to work:

UK Birth and Adoption Certificates
British citizens may also demonstrate their permission to work through their full UK birth or adoption certificate which includes the name(s) of at least one of their parents or adoptive parents, together with an official document giving their permanent National Insurance number and their name issued by a Government agency or a previous employer.

It's establishing the change of name which is tricky, so if the employer won't budge at an out of date passport, then renewing is the way to go!

There should be a list of what is appropriate to establish identity and right to work in the country. It usually is a combination of things depending on the documents. An expired passport will be part of it, but they will need to include another lot of documents, ie. electoral registration + bill no longer than 3 months etc... They need to ask their HR department for it.
