Please help

Hi MSE

Sorry if this is a common problem but can someone help please.

Last year I had a car accident which wasn't my fault. Several months later the claim was awarded to me on a "without prejudice" basis. This was good as I did not have to pay the cost of repair or lose my no laims discount.

Anyway, to cut a long story short the car is a total loss (unfortunately) and i was to receive the market value of the vehicle. This was given to me ad £1250.00.

I received a letter today from Direct Line saying I need to do the normal process of signing over my V5 etc. They also say they will forward me £1050.00. This is the £1250 minus £200 which is the excess.

This is the bit I don't understand & disagree with. I have won the claim so why am I paying the excess? It seems unfair.

I intend to contact Direct Line once I have gained some independent information.

Should I have to forfeit the £200 excess?
What do I do if I disagree paying the excess?
Is it right that Direct Line are charging me the excess?

Thank you for your time

Scott
