Caravan Issues - Claim on section 75 advice

Hi we are currently trying to claim for a section 75 for my father in laws caravan which was brought from a dealer completely unfit for purpose as it had serious damp issues which we unfortunately didn't notice before buying. They even stated it never should have been sold like that!! The dealer had the caravan back for repair and left it in an even worse state of damp issues (had an independent damp report done) which has us starting to believe that there might be structural damage. The amount we are trying to claim for is £5200, the question I needed answering is if I am successful in claiming on section 75 do I have to give the caravan back?

    of course you do, why would you think you could keep it and get your money back?, plus, why would you want to keep a problem caravan?
  • Thanks zx81, just thought I would ask as both me and my partner have had claims on section 75 and never had to give the goods back. Just wanted to be able to advise my father in law as the credit card company are making this difficult as trying to get out of it but at the end of the day they sold goods unfit for purpose, he isn't very clued up either on where he stands. So annoyed would hate for the dealer to have this back and to sell it to someone else in this state and for them to also do through this.

    If you claim under s75, a CC company pays from their own pocket and becomes the owner of the item.
    It's a different question whether they really want the item or CBA to make use of it.

    For chargeback it's different, and the item belongs to the supplier.
  • Thanks for your answers at least I have learnt that the cc company becomes the owner of the item. Lloyds had been telling my father in law that the dealer would want it back. Still in the early stages although been about four weeks now and nothing has happened other than the credit card company stating that as dealer have offered to repair they wouldn't refund. Hence a lengthy e-mail sent to them yesterday fingers crossed that this gets resolved.
