My wages didn't go in, can I claim bank charges back?!

I'm looking for advice, I was due to get paid on Friday 12/02/16, I was already overdrawn on my bank account resulting in me having to pay £5 per day, however with me not being paid on Friday and having to wait until Monday this will be an additional £15 being taken out of my bank account next month. My company will not say anything more than it being a processing error so I'm asking for help as to whether or not I can claim this £15 back as the error was not my fault?! Any help is greatly appreciated thank you

    Yes, you can as its a consequential loss resulting from an other party's error.


    If the processing error is the bank, they should refund you no problem - as there's evidence of the charges incurred.


    If your employer - more likely from what you have said - equally, just show them charges have been incurred as a result of their error.

    Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.

    It would be worth setting up an arranged overdraft even if you think you won't use it, as £5 per day is a lot to pay, even if you are only paying for days that were your fault.

    It may also be worth speaking to the bank about the possibility of them waiving the charges if this is a first offence, as many will.

    The Bank won't waive the charge in these circumstances if it's not their fault.

    If this "processing error" is the fault of her employer, then it is from them that she should request restitution.

    The OP said she was already overdrawn, so some of the fees she'll pay next month are her fault. It's these fees that are sometimes waived as a goodwill gesture/first offence let off.

    Fair enough. If, as you suggest, the other overdrawn fees are a one-off rather than a regular event then the Bank may indeed consider waiving them.
