Tesco Delivery Driver Damaged my wall

    Indeed but my main question was did they report immediately, which they hadn't specified.
  • Something that Tesco would be extremely unlikely to say because if they are aware of the fact that their driver had an accident and has not reported it as required by law, they themselves could well end up in the **** due to them being the registered keeper of the vehicle.

    If the van was fully on the drive what offence has been committed than and what is the requirement in law to report it. The drive may neither be a road or public place.

    Someone in the OP's family is hardly an independent witness. If Tesco claim no accident was reported by their driver or damage to their van, then it will be hearsay evidence.

    Tesco will probably pay up as a "goodwill gesture", but it's by no means cut and dried.

    While I can see what you are trying to say, this isn't hearsay.

    Section 170 of the Road traffic act - failure to stop at the scene of an accident and give details.
    (iii)to any other property constructed on, fixed to, growing in or otherwise forming part of the land on which the road [F3or place] in question is situated or land adjacent to such land.

    Thank you to everyone who responded. I did of course report it immediately to Tesco. I am not traumatized etc etc by what happened, it is a bit rude to read something into a persons post that is not there.

    However, I have never had anything like this happen to me or my property which was why I was asking here. Some of us are not as used to dealing with these things and just want to ask for some advice, no harm meant.

    It is no hassle to get some quotes, however, a number of things that are going on with my health etc that has required hospital stays etc over the last few weeks means that this was the last thing I want to do. I didn't want to add this information to my initial post in case.

    Indeed I would have went and got the shopping myself if I could have, thereby saving this. Being tired, ill, sore on medication etc may have meant that I got annoyed at the letter from Tesco. A home delivery was supposed to help my situation, not give me more to do.

    I don't know anyone who would not be peeved off at this given the circumstances.

    I will phone and get a few people out to get quotes.

    Thanks again to everyone who provided a helpful response.

    Where does it say that?

    It says you need to stop and give your details if you cause damage to property that forms part of the land on which the road is situated OR forms part of the land adjacent to such land (that the road is situated).

    It does not say that the property needs to be located along the border of the land which contains the road!

    I think the poster concerned was indeed being sarcastic, but not directly at you.

    His remarks were aimed at the many many posts which appear on this forum complaining of "anxiety" or "trauma" or any one of dozens of other psychiatric conditions, usually as a result of some minor mistake or poor customer service by a retailer.

    Someone in another thread was just recently complaining that there was no warning of possible harm to teeth from…chutney.

    Anyway, I'm sure you get the jist.
