The company name is listed on the credit card statement, not sagepay.
So is the consensus that I should continue pursuing the credit card company? Or should I also send a letter before action to the company?0 -
Then Section 75 of The Consumer Credit Act is applicable. The company name is listed on the credit card statement, not sagepay.

Have a read of MSE's Section 75 article.
I would pursue the credit card company in the first instance. If they still deny responsibility, then go on to the Financial Ombudsman Service. Even if the FOS don't come to the right conclusion you can still go on to small claims court if you wish.0 -
I contacted my credit card company (Creation) to enquire about a Section 75 refund, and was advised that Section 75 does not apply as the payment was fulfilled through an intermediary (Sagepay)The company name is listed on the credit card statement, not sagepay.
So how did the card company know about Sagepay? Did you tell them?So is the consensus that I should continue pursuing the credit card company? Or should I also send a letter before action to the company?
Yes. Just ask them for their address for their Section 75 claims and send them a letter making the claim. That way if they say "no" it is the department that deals with the claims rather than somebody in a call centre.0 -

I did not tell them.
Thanks, I'll let you know how I get on!0 -
So I got my money back from the vendor.
After doing plenty of research into his background and uncovering the names of his children, I sent him the following email:
"By the way, it was <Daughter's Name> that guided me to your site. I'll be sure to let her know about your business practises."
After zero communication up to this point, he responded 8 minutes later and confirmed he had issued the refund which I have now received.
So I'm conflicted. Obviously this guy is dodgy - do I name and shame to protect other people? Do I just walk away because he settled his debt with me? Is there a more formal way I can report my suspicions about this company?0 -

Wow.
Is it just me that finds this creepy and threatening?0 -
I don't think so0

While being threatening was not my intention, perhaps he did feel threatened, I don't know? I tried to be careful with my phrasing, but really I just wanted some kind of reaction from him.
Given that he returned my £1k 8 minutes later, I'm not going to worry about a thief with a history of stealing at least £145k from his customers.
Edit: If you're referring to 'threatening' to tell his daughter that he's a con-man, then yes I was. And I had every intention of writing to his family to let them know.0 -
I do see your point.0
