POPLA Decision REVERSED

Hi guys,

I wondered if you could help? I have x3 parking charges from UKPS and I've disputed all 3 with POPLA. The first two were one day after one another at my flat as the permit fell down and I didn't return to the car all week. The third one was a couple of months later.

Identical evidence was submitted to all 3 appeals, the first two declined and the third approved. I asked POPLA to revisit the first 2 but they've come back saying that for consistency, they have changed their decision on the 3rd appeal.

What shall I do?

We write further to your recent contact with our offices regarding the three appeals that we dealt with for you.

We note that we refused the two appeals dealt with under our reference numbers of “•••••/•••” and “•••••/•••” but allowed your appeal dealt with under our case reference number of "•••••/•••".

In relation to this, we would advise that POPLA makes every effort to ensure consistency across all the decisions that we make but there is always the possibility our assessors may have a difference of interpretation when considering the circumstances of an appeal.

In order to fully address your concerns, we have conducted a review of your three appeals and believe that all three of these appeals should have been refused.

Based on our review of the evidence provided, we note the issues you raised regarding the signage at the location but we have determined that it is evident that there are a number of signs at the location and the requirement to display the parking permit is clearly written on the permit itself.

As such, we believe that you were given the chance to be “aware” of the terms and conditions “from the start” as noted within Section 18.1 of the BPA Code of Practice.

As such, while we recognise the inconvenience to you, we feel we must reverse the decision we made on reference number •••••/••• in order to restore the consistency within our decisions.

Please treat this email as notification that we have reversed our decision in relation to this appeal and so we will now treat all three appeals as refused. We will notify the parking operator, TR Luckins of this change and so we would advise that you liaise with it to discuss your options going forward regarding the Parking Charge Notices you have received.

We appreciate your bringing this discrepancy to our attention.

    I doubt there is much that you can do, but I suspect your popla appeal was appalling as its normally easy to win at popla

    so assuming all 3 have been lost you have the option of paying them all, or not

    if you choose not to pay, then its a case of ignoring debt collector letters for the next 6 years , only asking for help if you get actual court papers

    you should have come here for help in the first place, so you could have used a better popla appeal and won all 3 cases, the advice would have been free and these matters would now have been concluded successfully

    you have omitted the dates


    as you might well know POPLa is now being admistered by a different company , I think the cut-off date was late September for the old one


    what dates did you SUBMIT your 3 appeals


    edit: 21 August 2015 was the cut off date for the old supplier (London councils)

    Hi Red,

    Thanks for the reply, the appeals were based in the signage being too heigh to read. This is the grounds the third case was granted on. I was unaware of this site/community when making the appeals.

    My question really is, is there anything i can do regarding the decision change from POPLA?

    so there we have the answer.


    all cases submitted UPTO 21 August 2015 were handled by London councils


    all cases submitted AFTER 21 August 2015 are being handled by the ombudsman services


    as per a FOI request the other day , London councils (popla) no longer hold records , they have all been passed back to the BPA

    Since it is each case on its merits were the facts of the cases identical. If not then "consistency" goes out of the window and "fix" comes in.

    May be something for the Lead Adjudicator if the facts were different.
