The stove has most likely been put on top of the inset hearth and the cement underneath has not set properly, so it has now sunk, making it wobble.

The flue pipe can move slightly. As long as it is sealed at the bottom and where it goes into the register plate, then no fumes can leak. The hole in the register plate will have been made a little larger than the pipe itself, so , firstly you can fit the pipe through it. Secondly, so it can be removed, if you need to get into the flue at anytime ( sweeping etc)

It sounds more cosmetic than mechanical.. I am in the fireplace industry and it is our busiest time at the moment. They will have booked jobs in for maybe a month or 2 in advance. Most shops are husband and wife teams, she runs shop, he fits. The only money coming in is from the jobs they fit and no, we are not made of money, I take home less than the av salary in the UK.The profit gets plowed back into the business. They are most likely trying to find a time they can come out and do it. It wont be a 5 minute job, they will have to relay the hearth and then refit everything again, more like 1/2 day to a days work.

Go in, talk rationally with them, show them video footage of the issue off your phone. You will get a better response than phone calls.

You could try, as a temporary measure fitting a chock under one of the legs, where it seems to be were it wobbles, to see if this stops it and also stops the flue pipe moving. That then will indicate if it is the hearth that is not level now. At least while you wait, it wont move. Use a piece of tile, slate etc and push it under the leg.

Just as an update, I emailed citizen's advice and my credit card company to see what they would advise me, and it seems both options are open to me.

However the stove company have since got in touch and been out yesterday to inspect it. They have agreed that yes there are faults and that they need to fix it within warranty, so I am hoping that they are as good as their word and come and do it.

Rustyboy, in reply to your post, yes the stove is set on top of the hearth (which they installed).
The shop has a number of branches so isn't simply a husband and wife team. When we went in to buy the stove there was at least six members of sales staff there, and we had two fitters out to fit it who were instructed by the branch we bought through.

My gripe was not that they couldn't fit the work in (if they had told me that it was going to be a month before they could get out to see it, I would have accepted that), I was more annoyed at constantly waiting for phonecalls, visits and inspections, that were all happening "later today" or "tomorrow" that never came.
