Son had accident - not his fault but other party saying it was....

    He has photos, if one shows the cars in their impact position it may help. However if it's a cas of the impact happened and both pulled over further down the road then it's one drivers word against the others and 50/50'seems the cheapest option for all.

    Thats my main fear - she simply says that the accident happened before that point or after it.

    Its her word against his. No doubt if she has to turn up in court she'll be there in court in tears describing how she'd been taking her disabled mum out shopping previously.

    Its a motability car, for the record.

    I had an at fault accident at 19, my insurance didn't sky rocket in fact it came down come renewal. Take the 50/50 .

    Hes had a previous at fault accident. And its quite a high grouped car for his age.

    His insurance has just been renewed without the settlement and its went up from £70 a month to £130 a month, when it should have went down.

    That was bearable for him for a few months, but its a painful jump of £720 a year at least.
  • We are going thru the same thing.. some guy drove into my lane and hit me exiting a roundabout.. as far as I am concerned its 100% his fault... insurance say he disputing blame so until its sorted we have to pay the £300 excess... I am so annoyed some other idiot cant drive and we have to pay £300...

    When you make a claim off your own insurer then your excess is always payable. It's an uninsured item (not covered by your insurer).


    So always select an excess you can afford to pay as in the event of any dispute as you have discovered it can take a long time for the liability issue to be resolved and longer before you get it back if you are found blameless (or partly blameless)

    NO! This woman entered HIS lane. She crossed lines, he stayed inside them.

    motorguy - I drive that road in Belfast sometimes. It's effectively a chicane by the road markings, which motorguy's son had driven within, and this 'lady' has straightlined.
    Where on your son's car was the damage? Answered - back, left side
    Where on the 'lady's' car was the damage? - Front, right side at a guess?
    You've already mentioned photos, but a diagram showing what happened would be great, this is easy to say behind a keyboard, but I'd like to see her argue against that in court.
    That 'government looking building' on the right is Belfast City Hall, and there may indeed be some CCTV footage.

    It says GO - IF THE WAY IS CLEAR.

    Don't just blindly tonk through. Sure, nobody SHOULD be going through t'other way, but they might be. There might be an emergency vehicle on blue lights. There might be some idiot who just hasn't bothered stopping. BE AWARE.

    Would an insurer say it put blame? Almost certainly not.
    Is it basic defensive driving? Absolutely.

    The way ahead was clear. OP's son was correct to proceed. This woman crossed white lines and hit his left rear. The issue isn't the lights anyway (it's a bus priority, pedestrian crossing), it's the change of lane. The 'strange' part is that on this straight road, if you keep your wheel straight, you'll change lane.
