What next?! Help!

Hello all,

Hoping someone can give me some advice, it's about my partners grandfather who has passed away.

He was in a council run care home and as far as we know the council had power of attorney. Now he has passed away we need to know what we need to do next? He has not left a will and of course we now need to organise and (try) and pay for a funeral.

  • The first thing is you do NOT have to pay for the funeral. The local authority have to pay if he had no money. Do not allow them to bully you into paying. Ask the care home for details of his finances if they had POA. Beware organising the funeral as you may then be liable for the costs. Come back here when you have more information on his finances.
  • If he had asserted over £23,250 when he went into the care home he would have been self funding, but once costs had reduced his savings to that level the self funding should have stopped, so there should be something left over.

    The first thing to establish is does his estates have any assets, and although the council's powers over his finances will have ceased on his death, they should have all the details to hand, so your partner needs to contact them ASAP.

    If the estate is insolvent however the family have no obligation to pay for the funeral, although they may wish to if they want something a bit more then the simple, but dignified, funeral the LA would pay for.
