DRO help please

Hi

I have a DRO in place, it started on the 27th October 2015. My children have children's bank accounts with the Halifax. I had an account with them but the overdraft was included in the DRO so they have closed my account. I went into a branch to ask, as my name is included (as the administrator) on their accounts, would they be affected. They spoke to the insolvency department who said they wouldn't, I needed to find out as I have my sons DLA paid in to his. So far there have been no problems withdrawing from it but today I went to withdraw money and was told I couldn't unless I had a letter from whoever dealt with the DRO saying I was allowed to withdraw the cash.
I just wondered if there are restrictions while on a DRO with regards to withdrawing cash as I was not informed about this and also if there are who would I get a letter from The Insolvency Service or Stepchange.

    Well, it won't be anything to do with stepchange. You are under the insolvency service now.

    I haven't come across this situation before and can't see why you should be prohibited from accessing your disabled son's DLA. That seems to be punishing him for your insolvency.

    When you say 'told' was that just verbally? Did you ask them to put that in writing? If not you should do. Once they have set out their logic, you can refer this to the DRO Unit. There's nothing to stop you asking them now. They deal with a lot more DROs than I do! They might have a view on this already.

    A bank can decide what to do with its own accounts but they could be found to have treated you unfairly - if they do not budge then you will need to refer this to the Financial Ombudsman Service to rule on it.
  • Many thanks for your reply. Yes it was just verbally. I went to withdraw cash and they said there was a note on the account stopping me withdrawing from it and asking for a letter. I will contact them and ask for reasons in writing. Many thanks again

    They've had a letter - the one from the DRO Unit saying you have a DRO and what debts are in it.

    It's called the Creditor's Notice

    I don't know what other letter they would be wanting.
