Capital one - and a default

My husband had a capital one account when he was 18 years old.
About 10 years ago he claimed back all the unfair payments on the account which they then closed and defaulted him.
We had to wait 7 years before we could apply for credit/ mortgage etc.
The reason I am bringing this up now is that there was PPI on the account and we didn't contest the default before - but surely they shouldn't have done this?
