PPI Claim accepted

Hi,
I have had a PPI claim accepted but, the company has only settled 50% of my claim due to it being a joint policy with my now ex-wife.
This was settled with a Claims Company that charged me a 25% fee.
I would like to claim the other 50% with the approval of my ex-wife without going through the claims company.
As the PPI Claim has already been accepted, is it possible to write to the company holding the other 50% with my ex-wife signature and settle this fully rather than using the Claims Company again?
Any help appreciated.

The complaint has already been concluded.steveg211067 wrote: »As the PPI Claim has already been accepted, is it possible to write to the company holding the other 50% with my ex-wife signature and settle this fully rather than using the Claims Company again?
All your ex-wife has to do is receive the money into her account.
She has no contract with the Claims Company and so does not have to pay them any fee.
Do note that the Bank is unlikely to pay it into your account with or without her signature. The Bank will want to be sure she receives the money directly.0 -
Hi, Thankyou for the quick reply.
I spoke to the Bank and they said my ex-wife would have to go through the complaints procedure to see if the other 50% would be accepted. Is this true? or are they just trying to fob me off?
In any case can my ex-wife just write or ring them and claim the other 50%?
Thanks, Steve0 -
Correct. Why would she have to complain separately ? Her half of the redress should already be waiting for her.steveg211067 wrote: »In any case can my ex-wife just write or ring them and claim the other 50%?
Make sure you furnish her with the details of your complaint, including the Bank's reference number if possible.0 -
Hi,
Could someone help me with the letter she would have to send to reclaim the other 50%.
Does anyone know where I can find a draft letter for this?
Thanks0 -

Dear Bank,
My ex-husband has had a PPI complaint upheld recently (date), the reference number was XXXXX. As this was a joint account, the Bank only paid my ex-husband 50% of the redress awarded and I'm writing to request that the remaining amount is now paid to me.
I enclose proof of who I say I am and my current Bank details.
Love,
Steve's ex.

If this is their process then yes she will need to register a separate complaint.0 -

Incorrect. The fact that the OP has had a complaint upheld about the sale of a policy does not necessarily mean that a complaint from his wife about the same would be upheld. It is possible that the complaint was upheld due to reasons which apply only to him but not to her e.g self-employment and the policy doesn't cover it, or a serious pre existing condition which would have prevented claim for a recurrence. So if their process is to investigate a separate complaint that's what she will need to do. In practice, most banks would probably not seek to defend a complaint from her if his has already been paid, but I have seen it happen.
On the plus side if it is dealt with as a separate investigation and she obtains redress then no she will not have to pay the CMC.0 -
That's fair enough, but a request for the money by the ex will doubtless be enough to initiate a new complaint if that is required. Even my somewhat tongue-in-cheek template would be enough to start the process.Insider101 wrote: »In practice, most banks would probably not seek to defend a complaint from her if his has already been paid, but I have seen it happen.Insider101 wrote: »On the plus side if it is dealt with as a separate investigation and she obtains redress then no she will not have to pay the CMC.
It's certain that the ex will not pay anything to the CMC whether the case is treated separately or not. The ex has no contract with the CMC and so owes nothing to them.0
