Rail Byelaw 14

Hi,

I have recently received a PCN on a rail station carpark, the previous PCN i received at this site has been discussed on another thread, however this one has different wording to the previous one and advises that:

"this car park is regulated by the terms and conditions of parking displayed at the car park in accordance with Rail Byelaw 14. By entering the car park you have agreed and are contracted to be legally bound by those terms and conditions"

I have done some reading and from what i can gather, rail byelaw's can be more complicated. My previous appeal on this land was referred to POPLA, and one prior to that was won on the 'landowners permission' argument.

Can someone advise how I should respond to this please?

ping pong , as you are aware , by laws are different and only the land owner (or solicitors) can bring charges , not the PPC , and they only have 6 mths to do this


take up a sport , second class ping pong , ask many questions and await many replies


PS , what was the offence? (exact)

Thanks Pappa Golf. The offence was Failing to display a valid ticket or voucher

Respond the same way as the other one. Use the template in the NEWBIES thread around day 25 as normal, then at POPLA stage you will also have the added appeal point that there can be no keeper liability as this land appears to be covered by bylaws and as such, it is not 'relevant land' for keeper liability under the POFA.

Says so in the NEWBIES thread! And it's important to know why you are delaying it and why you aren't naming the driver.

please also remember that there is no such offence under railway bylaws 14 , as failing to display.


there is an offence of failure to buy , but not one of failure to sisplay

appeal as per CMs comments , SAY NOTHING about bylaws , SAY NOTHING


let them think you are Mr gullible and stupid , lets see if they give you a POPLa code , chances are they will not.


however it all takes time , and you have all the time in the world (upto 6 months) then you can tell them to "do one"


say nothing at the moment , remember , (after 1st letter by POP 1st class) you go into second class ping pong mode
