You should be bringing the discrepancy to POPLA - one of the assessors got it wrong, and POPLA has been producing some pretty random and badly skewed results of late - presumably with the change they've got a lot of staff with no idea what they are doing.
John Gallagher has been allocated the role of Lead Adjudicator. Write to him with copies of both appeals and the respective adjudications.
Tell him there can be no public confidence in POPLA if, having received an upholding of your first appeal, an identical appeal for a second ticket with identical circumstances is rejected. Ask him to investigate the second appeal decision.
Surely it's time for POPLA to start putting together a precedents register. It would serve them far better than investing time in putting together off-the-shelf template responses as we are seeing in those cases they are bizarrely rejecting on Beavis grounds.Please note, we are not a legal advice forum.
