Mis-sold Holiday Insurance

Hi guys and girls!
I am here to ask whether it is possible to reclaim mis sold holiday insurance, my Gran recently discovered she has been paying £25 per month via direct debit since 2007 for Holiday/travel insurance that would not cover her due to existing heart problems. She only found out recently when she rang up to tell them about a knee operation and they said that it was not included and therefore would not have protected her had she fallen ill while abroad.
She believes she was missold the insurance. Is there anything we can do here?

Hi dunstonh, sorry for the late reply.
After looking through the bank statements the payments were to Phoenix life ltd. After speaking with my Gran she says that she was sold it by a clerk in the local Barclays Bank after being mentioning an upcoming holiday abroad. The clerk was told about the previous 3 heart attacks and an artificial elbow she had and was told that it would all be fine and she would be covered for illness abroad. Another selling point was "angel business perks" lounge at the airport which was the initial sales pitch.
She found out that she was not actually covered when she rang to tell them about a hip operation she had just received and was told that because of her 3 heart attacks the health insurance would not have covered her whilst abroad.
I hope I got things right, maybe someone can enlighten us on if and what is possible.0 -
Best thing to do here is make the complaint giving the reasons in a bullet point form.
There is actually nothing wrong with having a pre-existing condition not covered as long as the condition is not severe enough to prevent coverage of unrelated things. If the condition is severe enough to basically make the policy worthless (as so little would be covered) then it is an issue.I am an Independent Financial Adviser (IFA).
