    This is the issue Kitty78,

Everyone is entitled to be treated with respect in the workplace,

    Including the managing director?
many employers throw the term 'Gross Misconduct' without actually thinking of how it could affect the employee.

Many individuals don't come back from it, some will commit suicide, some will become homeless.

Wow heavy! I think that homelessness is a rare case which is more likely to happen to older people with no friends/family who can support them, maybe also with a history of gross misconduct (ie not learning how to keep a job) and possibly some psychological issues which all cause the employee to be unemployable to other prospective employers (not to mention lack of savings/pension plan). With respect to suicide that is just like homelessness but much heavier.

MOST people (95%?) who are sacked for gross misconduct will not resort to suicide/homelessness.
    Unless
they have done something so terrible that an employer has feared for their life or the life of others then
employers should be held accountable if there is another course of action, instead of immediate dismissal.

If someone brushed the managing director aside and said "get out of my effing way" then it can be seen as a violent action and one may well fear for their safety!

With you saying that gross misconduct should amount to situations when someone fears for their life, I would query whether this means that you could take a leather belt into work and start whipping people on their !!! a few times without being sacked for gross misconduct/prosecution? What are your thoughts? :)

I suppose that in the leather belt situation the "alternative course of action" would be 10 lashes in the reception area.

I'm utterly confused by this. Who says the thread will be removed? Why?

I think they are referring to xoids thread, he obviously didn't like the replies, threw a strop and got his thread removed, it's not hard to see why he's been sacked....Now he's on a mission to provide incorrect advice to others he feels are in the same position which this op obviously isn't as she hasn't been rude and aggressive to her employer.
    Sorry op....back to your thread.

I will be taking them to small claims if they don't pay me what I am owed.

As for turning it into a huge saga, I don't believe anyone should be treated in this way and I think the whole 2 year employment threshold is pretty poor.

It is basically saying if you have been employed for 2 years it is not ok to treat a member of staff this way but if you have been employed less than 2 years it is ok to treat them like !!!!.

Everyone has rights to be treated fairly and with respect, I for one would never treat someone in this way but unfortunately there are some nasty, manipulative, liars out there that have no idea about how to treat someone right.

As for work, I have been looking for work since the 13th January which was when they originally let me go, I have applied for work and so far had one interview. Part - time work in my sector is very scarce and what is out there is applied for by so many you rarely stand a chance.

Thanks for taking the time to read my thread though as many seem to comment only having read the first couple of lines.

Seriously... you expected people to read all of that? Have you read a forum post that large before? The the longest post i've ever seen, and ive seen some pretty impressive walls of text. In future, give a summary at the bottom, a summary is ALWAYS possible.

The poor guy who read it all managed to do it for you.
