Refund problems

Hi everyone,

I'm hoping for some advice. I bought a coat from Mountain Warehouse at the end of August that the zip broke on recently. I took the coat back, and they were happy to refund but only to the card I had paid on. I d not have the card I paid on anymore as it was subject to fraud and was cancelled. My current credit card is the same account - but they were unwilling to accept that and all they could do was give me a gift card for the amount - which I took, rather than going home with a useless coat. The problem is that I don't really want anything else from that shop at the moment, I want my money back.

I contacted them about this when I got home (as I was aware the manager at the shop had done all she could, having taken advice from customer services at the time) and their response was (my paraphrase) 'We're very sorry. but tough luck. We can't refund any other way for your protection and there's nothing we can do now you've accepted a gift card which is non-refundable; it says that in the small-print.'

I feel quite annoyed about the whole thing - they get to keep my money in their bank and I get a gift card that will gradually depreciate in value unless I spend it fairly soon. I can't seem to find any guidance that applies in this situation - does anyone know if there's anything I can do?

    Unfortunately, you have now accepted the remedy they offered. I fear that you are stuck.

    I am not sure how you should've handled the situation though.

    Can you seek a refund from your card supplier?
    Was it a debit card or a credit card?

    Can you sell the gift card to get almost all your money back? Ebay? Gumtree?
  • I realised that I maybe should have brought the coat home and pursued it at a higher level when I got their reply saying 'now you've accepted the gift card...'.

    It was a credit card - I had been thinking about contacting the provider to see what they have to say about it.

    It is my understanding that a refund can still be made to a deactivated card.


    It is used to pay any outstanding balance or returned to you as a cheque.
  • I don't think they'll do that now I've 'accepted' a gift card. Thanks though. I haven't even got the card as I shredded it after it was replaced.

    Accepting the gift card creates a new contract that replaces the old one. You are stuck with it or sell it.
