Partners ex employers still paying into pension

    You have read the document correctly and are sure that the employer/employee contributions related to a time after leaving?

    Clearly, you would be aware if money were leaving your bank account so you cannot be contributing.

    If the company are contributing in error then the company/administrator should sort out the mistake.

    I do not see how you would be liable to make any repayment.

    Though if there is a significant pot there one simply be the OPs by right.

    Logic and practice dictate that the person is put back in the place they would have been had an error not occurred.

    This would mean that either the pension, or at least those elements post leaving the job, would, simply be lost.

    The other alternative is that the sums would be paid and the employer contributions and growth would then be maintained, this could mean gaining a a £24k pot potentially for the outlay of a few thousand pounds, which could be reduced due to the company acknowledging they've made a mistake and/ or an allowance to make up those contributions over time.

    This does require some investigation and clarification but also some thought about what might be the nest option.
  • Surely the first thing to do is to write to the company, recorded delivery, informing them of the error, and asking them to reply in writing. Copy the letter to the pension firm. Chase up with both in writing after 4 weeks if no response. Keep records of contact.
  • I have spoken to the pension company and they have confirmed that they have a record of me but will not give any further information over the phone, not even the plan number. I need to write to them and request all of the information relating to the pension. Once I have that I can contact my former employer.

    It's a bit frustrating but I'm sure they have their reasons.
