Section 75 Refunded - What Happens to the Goods

I have successfully claimed against the credit card company under section 75 to get a full refund on a display cabinet that was delivered damaged.

I had offered the company I bought it from a week to come and pick it up which they were unwilling or unable to do, so I contacted the credit card company.

My question is now. What happens to the cabinet? I was told via text that the retailer has 45 days to raise an objection, but assuming they don't, what happens then. Am I supposed to find storage space for this cabinet until then? After the 45 days can I sell it?

  • Seven days would be I suspect considered unreasonable. You can sell it but if you do you need to get a reasonable amount (ie not sell it to a mate for £1.03 when it is worth £1030) and the money is theirs not yours

    Are you sure it was s75 claim, not chargeback?

    If s75, then the CC company pays from their pocket and after this it's between them and the retailer to sort everything out. If they take money from the retailer and retailer raises an objection, you have nothing to do with this. Also, the CC company owns the item and decides what to do with it.
    That said, I think it's possible that they paid you money provisionally, not as a final settlement of the claim. In this case they can make reservations like, say, the right to take money back within 45 days.

    Well the seven days I gave them was about six weeks ago, they did not make any attempt to collect it since then.

    Well I claimed under section 75.

    The only response I had from them (Tesco) was to confirm some details, then a couple of days later I received this text message:

    "Your dispute has been processed and refunded to your account. The retailer has 45 days to challenge this, we will contact you if this happens. Thank you"

    Also, it's a known fact that very often even bank staff don't know the difference between s75 claim and chargeback. So, without any paperwork you can only guess what they meant by "dispute".
