Ah I see, that makes sense. Well they have referred to the keeper as the driver in their letter back - 'you parked' etc etc which is surely making an assumption that the RK has admitted being the driver which is explicitly not the case and I made sure of that when appealing. What if they say to IAS they're claiming against the driver when infact the driver has not yet been identified?

Well if they are different they'll have issues, if they're not you can appeal anyway. There are less guessing games if you let them state a case first and it looks better in court if you've tried and failed than not even bothered. It can mean penalties in costs at court level even if the chance is lesser on the small claims track.
  • Hi there,

I was hoping you could all help me pls as i'm facing a similar issue relevant to this chain.

Essentially, i'm a leaseholder at my residence which has come complete with a parking space in a secured gated car park which I own and had to pay for with the flat. My car has been parked there almost everyday since January this year and displaying the permit on my dash since it was issued in February. The carpark as of March 2017 was monitored by PCM.

In mid-September, I went to the car park to notice 2 car parking tickets on my vehicle as I hadnt checked the car in a couple of days. The parking permit had slipped down the dash on these 2 days, and was partially visible under the black tint of the windscreen and could also see the outline of the ticket in PCM pictures.

I unfortunately replied and appealed to these tickets in haste without checking these forums in what I deem to be a factual reply stating that 1) I own the space, 2) can provide evidence of the parking permit, 3) that it's slipped and partially visible and 4) that my car has been parked in that space everyday since the start of the year clearly displaying a ticket which other PCM wardens must be able to attest to. Clearly I underestimated the compassion of this company who immediately rejected and then offered to sell me a permit holder at a small charge.

I have since read the forums which are very informative and regret appealing as PCM is not registered under BPA. This also means they now have my details.

The letter has given me 2 choices which are to either pay the fine or appeal to IAS, and hoping for advice on this forum as to what I should do. Any advise would be greatly appreciated.

    Best,
    H

To get advise you need to start your own thread and not simply resurrect a dead one like this.

Everyone is asked not to start a new thread before first reading the newbies faq thread near the top of the forum - all your queries are covered there, including a third option the letter didn't mention!
