Wren kitchen order - rights

Hi, I recently bought a new kitchen from Wren (probably a very big mistake) and have paid a 10% deposit. It's being delivered tomorrow. Problem is, they have mis-measured the kitchen - someone did come round to check my measurements; it wasn't me. In order for the sink they sold me to fit, we need to cut into the side of the next cabinet, which will then make the warranty invalid. (It's Wren who have said we'll need to do this.) They've also sold me boiler housing that is too small and makes the aligning cupboards just 110mm off the top of the worktop, making that pretty much useless. The store people aren't being very helpful and have pretty much said tough, nothing we can do, and I can't get through to head office.


My questions are:
  • Do I have any rights here? Can I/am I entitled cancel, as it's Wren who made the error?
  • If I were to refuse delivery tomorrow and cancel the DD, what would happen?

    If you know all this why did you buy the kitchen? The time to pull out was when it was all discussed and the problems with the sink were pointed out to you. It's strange that you would let it get to delivery time before asking questions.

    I didn't! All these problems were pointed out after a surveyor had come to measure the kitchen etc. and everything was declared good to go. Of course I wouldn't have paid for it had I known it wasn't going to fit properly and we'd have to damage cabinets etc.

    My partner paid with his debit card; the monthly payments are set up to start coming out of my account soon.

    Sorry - I should have said that these problems were pointed out to me by the people who are going to fit the kitchen.

    Have the correct size parts ordered for delivery and refuse the wrong sized parts.

    Monthly payments for what? Did you get a finance agreement?

    If they're not able to provide you with what was agreed - they're in breach, since it sounds like the reason they're unable to provide you with what was agreed is down to them failing to take reasonable care and skill when measuring.

    An agreement needs to be binding on both parties.

    If you do have a finance agreement then you possibly still have section 75 protection. Section 75 of the consumer credit act makes the lender jointly and severally liable with the retailer - you have the same rights against them as you do the retailer. But with the added benefit that should the lender reject your claim, you can refer it to the financial ombudsman for review and then can take it to court if that fails. With a retailer usually your only option is to take it straight to court and theres no guarantee of getting your money from them so it gives quite a bit of added protection.

    if you read the wren reviews , you will have signed to say the kitchen is correct and you need your fitter to check the measurements etc, its there usual get out clause , not sure if its legally correct though,

    i presume you are using your own fitter ? if so it should have been checked before buying.

    what does it say in the terms on the paperwork ?
