UKCPS ticket- rejected appeal- help!

I have been reading some of the threads but getting a little confused/overwhelmed with the sheer amount of advice -some of it which appears conflicting.

In August last year I parked outside my own flat (!) rather than outside the gates like usual, so I could be closer in order to move boxes to move house. I lived on my own on 4th floor and the lift was broken that day. So I parked closer to make this process slightly less awful and do-able. There were no signs r.e. tickets/rules of parking here, although I know you normally need a permit to park in the allocated spaces and open the gate (it was open that day though). I was not blocking anyone or preventing anyone from moving where I was parked. It is a lease car also.

I appealed immediately (don't know if this was wise now) citing various reasons, including moving house which I had read could be a valid excuse in this situation, the no signs, the lift, not causing a problem/obstruction and the unjustifiable fine (in terms of the amount).

I received a rejection of appeal letter a few weeks later but with no reason why.

I then forgot about things.. I am a busy, constantly exhausted doctor so I apologise for the vagueness of all this!

Now i have a letter saying the fine has increased to £125 and they threaten 'debt recovery action' if i don't pay within 14 days. They also threaten court eventually and say this will affect my ability to obtain credit or a mortgage, On the website they comically say don't listen to websites that say I can avoid this fine including this one!

It all looks very scare mongery and ridiculous.

However -realistically I don't think I have the time/effort to write a really outstanding letter back - other than re-iterating my previous points and asking why they did not address these.

Is it worth me doing anything or just paying up to avoid further problems?

Would really appreciate any advice, thank you

    the choice on what to do is yours to make as an adult, not ours to make for you

    the facts with UKCPS (and many others in the IPC) are that almost all appeals fail, appeals to the PPC and any appeals to the IAS, its rare for any appeal to succeed , so you were bound to fail but created a paper trail in case it goes to court

    they have 6 years to bring a court case, under the small claims track, known as an MCOL normally

    even if you lost in court, as its a civil court then as long as you paid the judgment within 28 days then no CCJ would follow, no court record and no it cannot affect your credit rating or mortgage etc, because you would have "settled" the matter

    the only time credit ratings are affected is non-payment of the court judgment , followed by a CCJ, which cn then be enforced and would be on your credit file

    so to have it go that far you would have to ignore the court proceedings and the judgment, no sensible person would do that , not for a couple of hundred pounds

    their only purpose is to make lots of money, so cancelling your pcn is the last thing they wish to do, hence why failure was always on the cards

    Dunno what "snarky" means.

    (Unless you mean "sarcastic"? If so you are out of order.

    Why would you come to a forum dedicated to not paying these charges to ask for advice on whether to pay or not?)

    Seems to me to ba a fair answer to your question. Redx is a valuable and helpful contributor to this forum as you can see from the number of posts made and, in fairness, you acknowledge this. But if you as a question that implies you are considering paying the swingeing charge, then, as this is a money saving forum with dedicated regular contributors who have helped countless MSE members avoid paying, you might expect the occasional sharp comment. We are here to help you save your money.

    Please do read the Newbies sticky thread at the top of the forum which contains lots and lots of great advice.

    these forums exist so you can ask for advice, not to be told what to do

    my opinion is that we are adults and make our own minds up based on the facts, so I gave you the facts, but I will not tell you what to do and neither will any other informed person who answers you

    if I go in a supermarket I dont expect them to tell me what beans I should buy, but I do expect them to have a choice and to give me enough information to make up my own mind, so i stand by my answer which guys dad has kindly copied and pasted including your question to put it into context

    I dont agree with the way you have been treated, I do admire the work that you do, but you should know better than most that the individual should make up their own mind on a course of treatment after being given the facts and what the various outcomes may be, my nephew had to decide if he would deteriorate to using a wheelchair and taking painkillers for a bad back condition, or take a 50/50 operation to restore his spine to a "working" condition, he chose the latter after all the facts were presented to him and has made a good recovery , but I would object to anyone making his mind up for him (on the same basis as my answer to you)
  • I'm not sure the OP realises that not standing up to these scammers is the worst possible decision.

    He/she needs to read up on these cases involving UKCPC. The regulars will remember a case in the South of England where the leaseholder took them to court and won damages for harassment.

    I can't understand even a very busy person not standing up to, basically a theft!

    I regard the antics of some PPC's no better than the people who rob the elderly of their life savings. If the OP didn't sign into the agreement to display a permit they have no need to, end of story.

    that was UKPC, this is UKCPS, totally different company who do take people to court

    but I do agree their may be grounds for winning this in a court case

    That's fine. Letters (as per post #4 of the NEWBIES thread). Ignore them. Scaremongering indeed.

    A small claim would be defendable, come back if you get court papers or a LBCCC.
