My father passed away and was married for 6 weeks

Sorry for the short title it doesn't really explain a lot, but here goes,
My father passed away 2 years suddenly which turned out to be heart disease, a year earlier to this so (3 years) ago my grandfather passed away to cancer, he was a retired major in the Royal engineers, he owned his own home etc, when my grandfather passed away everything including the sale of his house was split equally to my father and his brother, then a year later my father married his new partner and 6 weeks after there marriage he sadly passed away leaving no will apparently, which meant everything went to his new wife, now please don't get me wrong I'm 24 now I'm not some money grabbing little child when I'm asking for help/advice and explaining all of this, after my fathers passing everything he was left which was pretty much everything my grandfather left him went to his new wife which I don't see how it's fair, she quickly booted myself and my brother out of her life and has gone onto leading a very luxurious life now and says we don't deserve anything until she passes away which then she would EQUALLY split whatever was remaining between myself my brother and her 3 children, I soon gave up trying to talk to her but for the last 2 years it has always been in the back of my mind that myself and my brother must have some sort of right to something of my grandfather/father estate, I have tried talking to her and explaining that it's not for me as I have 2 children that my father never got to meet and that it would be for there future as my father gave me a lot as a child growing up and obviously he would want that for his grandchildren but she doesn't seem to understand or see it that way, I've thought about going to civil rights meeting but can never get an appointment at my local library and I don't think taking legal action would get me anywhere apart from a nice big bill, if anyone could possibly just give me some advice whether my family (brother, my children his children) have a case or right to something or if I should just give up at finally put it to bed and move on I would gratefully appreciate it,
(Sorry if there's any spelling mistakes, using a phone)
Many thanks

Unfortunately you should just give up. Intestate laws means she gets the lot (up to £250,000).
If she has no will then her assets will be equally split among her children only. You will not get a share of that either despite what she says.
All you can really do is ask and if she says no well...that's it.:footie:
Regular savers earn 6% interest (HSBC, First Direct, M&S)
Loans cost 2.9% per year (Nationwide) = FREE money.

Thank you for your quick reply,
It's a shame in the view of my children as it's always been through our family of the child or grandchild has been given a lot as a result of hard work from the parent and well my fathers new wife didn't have a lot and obviously enjoyed the many holidays gifts etc he bought for her, so once he passed she's been quite selfish and quickly ran with everything, anyway onwards and upwards...0 -
Oh that people who were contemplating a second marriage made a will in anticipation of marriage, if they have children from a previous relationship. If you've have not made a mistake, you've made nothing0

It is no good saying your father would have wanted his children to have some of his wealth.
The law is the law, he should have made provision in a will.
Nothing you can do.0 -
Assuming you are UK, "civil rights meeting" is not a term used in the uk
and if scotland then things are a bit different again
I would try to find out how big your fathers estate was as if big enough you may have been due something.
Did father talk to his brother? he would know how much was inherited by them and may have known if there was a will that would be my first enquiry.
If there was a will then it may have been done by a solicitor so that may be an angle to persue.
Problem is any done before the marriage would no longer be valid unless done antisipating the marriage but the same solicitor may have done a new one.
You could see if the estate was administered(do a probate search) and you could try to trace what happened to any property through land registry or even the on-line sales data if sold.0 -
Sorry you ended up being in this situation. And I hope you can find a solution if there is one. However....POPPYOSCAR wrote: »It is no good saying your father would have wanted his children to have some of his wealth.

Sensible remark! Liam you can't guess his tone of voice, might have been innocent enough. He's got a point and it is just a simple statement.finally tea total but in still in (more) debt (Oct 25 CC £1800, loan £6453, mortgage £59,924/158,000)0 -
All you can do now is not make the same mistake as your father, and sort your own will out.0

Liam
I feel for you; very much the same happened in my family.
But there was nothing we could do. That unfortunately is the law.If you've have not made a mistake, you've made nothing0 -

A question now for you - have you made a will ?Never pay on an estimated bill. Always read and understand your bill0 -
