Ordererer something not sent on time, nos asked to return at own cost: what now?

    I'm pretty sure about that, I got a phone call from them 2 years ago asking for my company details, to which I said I am a private consumer. As a company I can have a trade account, as a consumer I pay upfront.

    It makes sense they add that as basically the kind of products they sell are quite specific and not something typically covered by a guarantee, but it surprises me they can do as they please regarding other issues. Does it mean whenever i have a problem with them is up to their sole discretion to deal with it?

    No, it is not at their 'sole discretion'.
    They have to abide by the terms that you and they have agreed to.

    Also, as a business purchaser, you do not have the protection that consumer legislation might offer.

    Well my question was simple, I expected to get an item before noon on the next day and didn't as for whatever reason they couldn't process an order that was sent before the cut out time for next day delivery. Not ideal, but fair enough.

    Do I still have to pay the pre noon charge, assuming the items are delivered tomorrow? Its not like they gave me the option to change for anything else, apparently I should have guessed that they haven't posted and made changes before that

    Unfortunately I dont think there's nothing on their T's & C's to cover this.

    The simple answer is if they have not supplied you with the paid for service, they should refund that amount.

    However, that does come with a caveat - if you have agreed to waive the right to a refund of that sum, then as a business purchase, you can do that.
