PCN Britannia Parking, Parking over two bays.

Hi guys,
I've read the newbies bit but most of it dosen't apply to me bescause of the "infraction". So i was parked over two bays didn't realise this would cause me to have a ticket for 85 quid! I use a dashcam so i watched the footage from that and all the signs i drove past said conditions apply, dose this mean it isn't clean enough and should appeal?

You've still got all of the other points - can you read the signs from the dashcam? Did you notice the signs from the car? Are they entitled to issue tickets there? Have they conformed to POFA 2012 and therefore have the entitlement to enforce against the registered keeper?
This is assuming it's a private parking company though, based on the £85 ticket. Who issued it?
Not that I condone parking over 2 bays unless you had a good reason (I take up 2 with a trailer, for instance, or if the bays are too small)0 -
Yes you can read the signs i went past from the dashcam. No i didn't notice them from the car. I'm pretty sure they are entitled they are part of the BPA group. The ticket was issued by Britannia Parking.
I didn't realise it was two bays to be honest i do think you could of got two cars where i was parked.0 -
Being part of the BPA doesn't mean they are entitled; they need permission from the landowner to do so, and they need to prove it. They also need to comply with a complex set of regulations in order to claim keeper liability, which they always fail to do.
If you genuinely didn't see the signs when driving in you can make that point - they weren't obvious enough to form a contract.
Now you can read them, do they mention the charge, who the debtor is and anything about the violation they wrote on your ticket? i.e. was the specific condition mentioned?
I'm assuming this was just a windscreen ticket at this stage? If so, wait for them to send you something in the post and respond to that, exactly like any other invoice in the newbies thread. Unless it's Scotland/Ireland, in which case you can ignore it.0 -
The sign as you walk into the car park just says pay and display terms and conditions apply. see notices in the car park for more information. Yeah it was a windscreen pcn that happend yesterday. Just seems like a lot of money!0

As it's Britannia, as long as you are the car owner/keeper, wait and see if a Notice to Keeper arrives first.So i should just use the template in a few weeks then?
Britannia can't get electronic access to DVLA data any more, I believe, due to being norty last year, so they'd have to make a manual application (if they are allowed, I'm not sure if they are fully banned at the moment, just basing this on something someone else said).
So wait. And then send the NEWBIES thread template if a NTK arrives. I've had Britannia PCNs before now which they never followed up at all, in any way. They are also dead easy to beat at POPLA if you do end up having to hop through the 2 stage appeal, as long as you stick to our script for each stage.PRIVATE 'PCN'?
