PPI Queries

So I got lucky with Nat West and they paid back the PPI for my loans.


I took out a Credit Card with them in 1998 and was told to take out PPI by the member of staff - this complaint wasn't upheld because there was no record of my application. (Is there anything I can do?)


I had PPI with an Egg Credit Card, taken out in 2001, can't remember if the PPI box was preticked but I had been advised by a customer services rep to accept it because it increases the chances of better credit scoring. This wasn't upheld, went to FOS who said that the balance of probabilities was in Egg's favour. (Can I reclaim?)

    You cannot pre-tick a paper form.

    Did you borrow on the card or did you pay it off each month?

    You complained and lost your complaint with the firm. You went to the FOS and they correctly rejected it due to lack of evidence. Thats it. Game over. You cant repeat complain.

    When you make allegations, the available evidence from either side has to support your allegation to succeed. Where there is no evidence available, a balance of probability decision is required to be made and this tends to swing to the most credible side. Verbal allegations are considered but by themselves, they are weak and usually fail on that particular point.

    Egg have a record of when they used pre-ticked (opt-out) PPI boxes, if yours was outside that period (assuming you were applying online) then if you had it either you ticked the box (so not miss-sold) or it was taken out on the phone after - if it was the former as their case suggests, unfortunately that is it for you as you have not provided evidence of wrongdoing.

    It was an online application. It wasn't paid off each month but ok.


    What about the Nat West Credit Card?
