    Your commiting benefit fraud by claiming for a property you don't live in.....Your ex could of acted as a guarantor and you could of legitimately claimed HB for the property you do live in......These things eventually come to light and both yourself and your ex will be in trouble....The obvious answer is to swap properties otherwise you will end up homeless.

    You've both caused a mess by trying to claim for something your not entitled too....Your ex is sub-letting the property you live in which could see you being thrown out and her in trouble with the landlord... You claiming for HB for a property you don't live in, the rent on the property she lives in is being paid by a benefit that is being fraudulently claimed, you could both find yourselves on the streets if it all comes out.
    Get a list of landlords that except HB off the council and try and sort the mess out.

    No you can't claim HB. The 'bit of paper' whether it's an AST, lodger agreement, whatever, sets out your 'right' of occupation, terms, length, cost etc. You have no right to be there. It is costing you nothing. So HB is impossible.

    Then you are committing fraud. There are no ifs or buts you are fraudulently claiming Housing Benefit on a property you left a couple of months ago. Irrespective of the rental liability you are not living in the property. If your Council finds out your claim will be cancelled and you will be invoiced for the overpayment.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    As you don't live anywhere legally you can ask to be rehoused in emergency accommodation as soon as the person owning the tenancy asks you to leave and puts you on the street.

    If you leave the property first thing in the morning on a working day you should be in emergency accommodation by that same evening.

    Emergency accommodation is temporary and you have to pay for it but at a discount rate.
